1. Agreement to Terms
By downloading, installing, or using the Fince mobile application ("Fince", "the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("user", "you") and Appxcellence Solutions LLC ("we", "us", "our"), the developer of Fince.
2. Description of the Service
Fince is a personal finance tracking application for iOS. The App enables you to:
- Manually log income and expense transactions
- Create and track monthly budgets by category
- View statistics, trends, and charts of your spending
- Receive local notifications when budget thresholds are reached
- Interact with an AI assistant that provides insights about your financial data (Premium feature)
- Generate weekly AI-powered financial insights (Premium feature)
- Export your transaction history to CSV (Premium feature)
- Protect the app with Face ID, Touch ID, or device passcode
Fince does not connect to your bank accounts, credit cards, or any external financial institution. All data is entered manually by you and stored locally on your device.
3. Not Financial Advice
Fince is a financial tracking tool, not a financial advisor. The AI-generated responses, insights, Health Score, and any other content provided by the App are for informational and educational purposes only.
The App does not provide investment, tax, legal, accounting, or other professional advice. You should not rely solely on Fince for financial decisions. Always consult a qualified professional before making significant financial decisions.
We make no guarantees about the accuracy, completeness, or timeliness of any calculations, suggestions, or insights. Use of any information from the App is at your own risk.
4. Subscriptions
4.1 Free and Premium Tiers
Fince offers two access levels:
Free tier: includes unlimited transaction logging, basic dashboard, limited budgets, limited AI messages per month, and basic statistics.
Premium tier: unlocks unlimited budgets, unlimited AI chat messages, unlimited weekly insights, CSV export, and other premium features.
4.2 Pricing (as of publication)
Premium subscriptions are available at the following prices (in USD, equivalent prices apply in other currencies based on Apple's regional pricing):
- Monthly: $6.99 / month
- Annual: $39.99 / year (equivalent to $3.33/month, approximately 52% savings vs. monthly)
Both plans include a 7-day free trial. You will not be charged during the trial. If you do not cancel at least 24 hours before the trial ends, the subscription will automatically convert to a paid subscription at the selected price.
Prices may change. Existing subscribers will be notified in accordance with Apple's App Store policies before any price change affects their subscription.
4.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current price, unless you cancel at least 24 hours before the end of the period.
Your iTunes/App Store account will be charged at confirmation of purchase and at each renewal.
4.4 Cancellation
You may cancel your subscription at any time through your Apple ID settings:
iPhone: Settings → [your name] → Subscriptions → Fince → Cancel Subscription.
Cancellation takes effect at the end of the current billing period. You retain Premium access until that date. No partial refunds are issued for unused time.
4.5 Refunds
Refund requests are handled exclusively by Apple. We (the developer of Fince) cannot issue refunds directly. You may request a refund through Apple at: https://reportaproblem.apple.com
Apple's refund policy applies. Refunds are granted at Apple's discretion.
4.6 Changes to Free/Premium Features
We reserve the right to change which features are available in the Free tier versus the Premium tier. Existing Premium subscribers will continue to have access to all Premium features for the duration of their current subscription period.
5. Your Use of the App
You agree to:
- Use the App only for lawful purposes
- Enter accurate information (though we do not verify it)
- Not attempt to reverse-engineer, modify, decompile, or extract source code from the App
- Not use the App to store or process data for others without their consent
- Not abuse the AI features (e.g., automated scraping, off-topic spam)
- Not attempt to bypass the Free tier limits through technical means
We reserve the right to terminate service (without refund) for users who violate these Terms.
6. Intellectual Property
All content, design, code, graphics, icons, and branding of Fince are the intellectual property of Appxcellence Solutions LLC and are protected by copyright, trademark, and other applicable laws.
You are granted a limited, non-exclusive, non-transferable license to use the App on Apple devices you own or control, subject to Apple's standard End User License Agreement ("EULA") available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
Your personal financial data that you enter into the App remains yours. We claim no ownership over it.
7. Third-Party Services
Fince uses third-party services that have their own terms:
- Anthropic Claude API (for AI features): https://www.anthropic.com/legal/consumer-terms
- Apple App Store and StoreKit (for distribution and subscriptions): https://www.apple.com/legal/internet-services/itunes/
By using Fince, you also agree to the applicable terms of these third-party services.
8. Disclaimers
8.1 "As Is" Basis
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
8.2 AI Output
AI-generated content may be inaccurate, incomplete, or misleading. We do not guarantee that any AI response reflects your actual financial situation correctly. Always verify AI suggestions against your own judgment and qualified professional advice.
8.3 No Guarantee of Continuous Service
We do not guarantee uninterrupted access to the App or its AI features. Service may be interrupted for maintenance, updates, or due to issues with third-party providers (Apple, Anthropic).
8.4 Data Loss
You are responsible for backing up your device. We are not liable for data loss resulting from device loss, theft, malfunction, OS updates, or accidental deletion within the App (including use of "Reset all data").
9. Limitation of Liability
To the maximum extent permitted by law, Appxcellence Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, savings, data, or business opportunities, arising from your use of or inability to use the App.
Our total cumulative liability to you for any claims arising from these Terms or the App shall not exceed the amount you paid to us for the App in the twelve (12) months preceding the claim, or USD $50, whichever is greater.
Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Appxcellence Solutions LLC, its affiliates, and employees, from any claim, demand, loss, or damage, including reasonable legal fees, arising from:
- Your violation of these Terms
- Your misuse of the App
- Your violation of any applicable law or rights of a third party
11. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately.
You may terminate your use of the App at any time by uninstalling it and cancelling your subscription (if any).
12. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated via an in-app notice or by updating the "Last updated" date at the top of this document. Your continued use of the App after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of Morocco, without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Morocco, except where applicable consumer-protection laws grant you the right to bring a claim in your own jurisdiction.
14. Apple-Specific Terms
As required by Apple, the following terms apply when you use Fince on an Apple device:
- These Terms are an agreement between you and Appxcellence Solutions LLC, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims by you or any third party relating to the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App. They supersede any prior agreements or communications.
